Keep in mind, innocent til proven guilty. Seems this case is a long way from over and this young man may have a chance to start his life anew at Bethune Cookman after transfering in from Florida, where he was granted his release. Best of luck to Avery Atkins...

Atkins charged with battery

Avery Atkins, the former Mainland football star who recently was granted his release from the University of Florida, has been formally charged with one count of first-degree misdemeanor battery in connection with an incident last month with his child's mother, said Linda Pruitt, a spokeswoman for the state's attorney office.

The charge carries up to one year in prison and/or a $1,000 fine.

"It's fair to say that we took our time with this," Pruitt said. "We've reviewed the file and have spoken with witnesses and we felt the evidence supported a domestic battery charge against Mr. Atkins."

Pruitt said an arrest warrant will not be issued against Atkins. She also said Atkins will not be required to turn himself in. Pruitt said a notice to appear in court will be mailed to his home.
